These Terms of Service ("Terms") govern your access to and use of the ServiceWizard platform and services provided by ServiceWizard LLC ("ServiceWizard," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms and Apple's App Store Terms and Conditions.
By creating an account, accessing, or using the ServiceWizard platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.
ServiceWizard is a software-as-a-service (SaaS) platform that provides business management tools for service-based contractors. Our services include:
To use ServiceWizard, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

ServiceWizard provides SMS (text messaging) functionality as a core feature of our business management platform. As a ServiceWizard user, you can use our app to send text messages to your customers for business communication purposes.
How SMS Works in ServiceWizard:
Important: ServiceWizard is a platform that enables business owners to communicate with their customers. ServiceWizard does not send messages directly to consumers. Instead, you, as the business owner, initiate and control all SMS communications with your own customers through our platform. Messages are sent on your behalf and appear to come from your business.

ServiceWizard uses third-party messaging providers (such as Twilio) to deliver SMS messages on your behalf. These providers handle the technical delivery of messages. Your use of SMS through ServiceWizard is also subject to these third-party providers' terms of service and policies.
SMS messaging through ServiceWizard may be subject to usage limits based on your subscription plan. Message and data rates may apply to recipients. You are responsible for any costs associated with sending SMS messages through our platform.
You must honor all opt-out requests from customers immediately. When a customer replies "STOP" to any message sent through ServiceWizard, you must not send any further messages to that phone number. ServiceWizard provides tools to help you manage opt-outs, but you are ultimately responsible for compliance.

ServiceWizard offers both free and paid subscription plans. Paid subscriptions are billed on a monthly or annual basis, as selected by you. All fees are non-refundable except as required by law or as provided by Apple's refund policy.
Apple App Store Purchases: All in-app purchases and subscriptions are processed through Apple's App Store. Payment processing is subject to Apple's Terms and Conditions. Apple handles all payment transactions, and refunds are subject to Apple's refund policy.
By making a purchase through the App Store, you agree to Apple's payment terms and conditions. ServiceWizard does not directly process payments for App Store purchases.
We reserve the right to modify our pricing at any time. Price changes will be communicated to you in advance and will apply to subsequent billing periods. For App Store subscriptions, price changes are subject to Apple's policies and procedures.
The ServiceWizard platform, including all content, features, and functionality, is owned by ServiceWizard LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without our express written permission.
You retain ownership of any content you upload or create through the ServiceWizard platform. By using our service, you grant us a license to use, store, and process your content solely for the purpose of providing our services to you.
You are responsible for ensuring that any content you upload does not violate any third-party rights or applicable laws.
ServiceWizard integrates with third-party services, including payment processors (such as Stripe) and messaging providers (such as Twilio). Your use of these third-party services is subject to their respective terms of service and privacy policies.
You may terminate your account at any time by contacting us or using the account deletion feature in the app.
We reserve the right to suspend or terminate your account immediately if you violate these Terms or engage in any fraudulent, illegal, or harmful activity.
Upon termination, your right to use the service will immediately cease. We may delete your account and data, subject to our data retention policies and applicable law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICEWIZARD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
You agree to indemnify and hold harmless ServiceWizard LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the service or violation of these Terms.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of the service after such changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ohio.
